Update Regarding BNC Service Disruption (October 27, 2026)
  • The BNC has begun processing Certificates of Notice for data polled on October 7 and will resume mailings for data polled on October 8, while concurrently processing newly received court submissions.

Electronic notices will be transmitted as soon as validation is complete, allowing multiple backlog days to be processed simultaneously as capacity permits. Paper notices will be handled separately and released in prioritized waves based on production capacity and mailing readiness.

To address delays caused by the outage, all paper notices generated between October 13 and the present will include the following message on the address page:

IMPORTANT NOTICE: The enclosed notice(s) may have been sent later than intended due to a service disruption affecting the Bankruptcy Noticing Center. The information contained in this notice remains valid; however, because of the delay, a deadline or response period identified in the notice may have already passed, and you may receive an amended notice. If you have questions regarding a deadline or response period, please contact your attorney or visit the website of the clerk’s office for the court identified in the notice.

In addition, on October 22, 2026, the Judicial Conference declared a nationwide “Bankruptcy Rules emergency” pursuant to Federal Rule of Bankruptcy Procedure 9038 in response to the ongoing disruption of services provided by the Bankruptcy Noticing Center (BNC). The declaration applies to all United States Bankruptcy Courts and remains in effect for a 90-day period beginning October 9, 2026, through January 7, 2027, unless terminated earlier.

Although BNC has announced that services are beginning to resume, we anticipate that the emergency declaration will remain necessary throughout the restoration period. The declaration provides important flexibility to ensure that courts can address the effects of the outage and helps protect parties from potential prejudice resulting from delayed notice and related service disruptions. Additional information and guidance regarding the emergency declaration will be distributed as it becomes available.

General Order No. 26-0003 remains in effect. If you did not receive timely notice of a deadline, hearing, or other matter because of the disruption, you may file a motion in your case requesting relief; the Court will consider requests on a case-by-case basis. For questions, contact the Clerk’s Office at 901-328-3500 or Case Administration at operations@tnwb.uscourts.gov. The Clerk’s Office cannot provide legal advice.
