Effective December 1, 2023, the Director of the Administrative Office of the United States Courts has designated any entity that has been sent 25 or more paper bankruptcy notices in a single calendar month as a high-volume paper notice recipient pursuant to Fed. R. Bankr. P. 9036(b)(2)(B) (as amended effective December 1, 2021) (the “Rule”). The threshold number of paper notices that will cause a notice recipient to be designated as a high-volume paper notice recipient pursuant to the Rule will be reviewed annually and may be adjusted once a year, effective on December 1st of each year.

Once the threshold paper notice amount is reached, the Bankruptcy Noticing Center (BNC) will notify the notice recipient that it must register for Electronic Bankruptcy Noticing (EBN) or that, if the recipient does not register within 45 days of the date of the notification, the BNC will establish an electronic address where the Director designates the recipient to receive its notices pursuant to the Rule.

To avoid any delays or inconvenience that may arise due to the enforcement of the Rule, high-volume paper notice recipients are encouraged to go here to register for EBN.[11/2/2023]

Senate Bill S. 3823 was signed into law on 6/21/2022. This law restores the debt limits for Chapter 11 Subchapter V to 7.5 million for a period of 2 years. It also increases the debt limit for Chapter 13 debtors to 2.75 million, for the two-year period.
On April 1, 2022, adjustments to the dollar amounts stated in various provisions of the Bankruptcy Code and one provision of Title 28 of the United States Code will go into effect for cases filed on or after that date.

A chart showing the affected sections of the Bankruptcy Code and Title 28, with current and adjusted dollar amounts in those sections, can be found here. The adjustments reflect the change in the Consumer Price Index for All Urban Consumers published by the U.S. Department of Labor.

The revised forms will be effective on April 1, 2022, and they will apply to cases filed on or after that date. Pending changes in the Bankruptcy Forms can be found on uscourts.gov. Updated local forms will be posted to the court’s website on March 31, 2022. [03/10/2022]
